The federal appeals court has upheld a ban on deploying national guard in the Oregon city, after a recent legal decision.

Appeals Court Concurs to Rehear Case

The federal appeals court decided on Tuesday that it would rehear the case concerning the executive power with an larger group of eleven justices. The judicial body also overturned a earlier ruling from a three-judge panel that had supported the administration.

Ongoing Dispute Over Troop Deployment

This order represents the most recent turn in a long-running legal battle over whether the administration has the authority and valid reason to deploy national guard forces in Portland. Approximately two hundred troops have been in uncertainty since the end of September when the mobilization attempt was started in response to ongoing demonstrations.

Conflicting Arguments

The federal government has claimed that federal officials at the immigration center in the southern part of the city were under attack, while city and state officials assert that municipal police have command of the situation.

Contrary to characterizations of Portland as “war ravaged”, residents have been posting footage of scenic paths and a vibrant culinary culture, and planning activities such as an protest bicycle event against the increased military presence.

Court Proceedings

The Tuesday ruling came after a federal judge in Portland issued two temporary restraining orders this month – one preventing the federalization of the state troops, and another prohibiting the deployment of any military personnel in the state, after efforts to evade the initial injunction by calling up out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting command of 200 Oregon national guard – but the second ruling remained in place, blocking the actual deployment of the troops.

The Tuesday decision means the issue will be heard by the full court – with all decisions under consideration together – by a group of eleven justices.

“This ruling shows that the truth matters and that the judicial system are working to ensure government responsibility. The founding document limits the executive authority, and local populations cannot be treated as a testing site for unchecked federal authority,” said the state attorney general in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the armed forces into American urban areas without cause. We will continue protecting state legislation, principles, and sovereignty as this legal proceeding moves forward and our fight continues in the courts.”
